I hope all is well. As you can see, I have attached a copy of the draft with my proposed changes. I think it prudent to review the material as soon as possible. I believe there is a case in the 2nd Circuit that is on point, which is to say that it presents factual circumstances completely supporting our position. I believe the case name starts with an S--Smith, Swift, or something like that. I hope that helps your search. I need this draft first thing Monday morning at 9 AM.
On a lighter note, I understand that your family is visiting this weekend. I hope you have a great weekend, and don't work too hard.
PS - Now that I think of it, the case may not start with S. Actually, you might want to broaden your search to the 3d, 4th, 5th and 6th Circuits.
